When Does An Appeal Occur?
Once a defendant has been found liable in the trial courts, he or she can, and many times does, seek to have the trial court's decision reversed by the court of appeals. It is not enough, therefore, to win in trial court; that win must often be defended in the court of appeals. Similarly, sometimes a trial court will rule that the plaintiff does not have a valid claim, in which case the plaintiff must appeal to the court of appeals and seek to have that decision reversed.
